Refund & Cancellation Policy
This policy explains your statutory 14-day right of withdrawal for distance contracts, the special rule for digital content not supplied on a tangible medium, and how we handle support requests after purchase.
1. 14-day right of withdrawal
If you are a consumer in the European Union (or another jurisdiction that grants equivalent rights), you generally have the right to withdraw from a distance contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.
To exercise the right of withdrawal, you must inform us of your decision by a clear statement (for example by email) before the period expires. You may use a free-form notice; no special form is required.
Send notices to: ClarityPeak Academy, Heinestrasse 2, 1020 Vienna, Austria, email support@claritypeak.de.
2. Effects of withdrawal
If you withdraw from the contract in accordance with this policy and applicable law, we will reimburse all payments received from you without undue delay and in any event no later than 14 days from the day we are informed of your decision. Reimbursement is made using the same means of payment as in the original transaction, unless you expressly agree otherwise. You will not incur fees for the reimbursement.
3. Critical digital content exception
Our products are digital content that is not supplied on a tangible medium (video streaming and downloadable educational files). Under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) and the corresponding Austrian implementation, the right of withdrawal expires if:
- you have given your prior express consent to begin performance during the withdrawal period;
- you have acknowledged that you thereby lose your right of withdrawal once performance has begun; and
- we have provided confirmation of the contract on a durable medium.
Therefore: for digital content not supplied on a tangible medium, you agree to immediate performance and acknowledge that you lose your right of withdrawal once streaming access has commenced. This consent is collected at checkout before payment is completed.
“Streaming access has commenced” means that member credentials have been issued and the video library has been made available to your account, whether or not you have finished watching any particular lesson.
4. Voluntary satisfaction process
Independently of the statutory position, if a technical issue prevents you from accessing content you paid for, or if a product page was materially inaccurate, contact support@claritypeak.de within a reasonable time. We will investigate and, where appropriate, restore access, provide a reasonable remedy, or issue a refund at our discretion.
This voluntary process does not limit any mandatory consumer rights that cannot be waived.
5. How to request help
Please include the email address used at checkout, the programme name, the approximate purchase date, and a short description of the issue. We respond within 24–48 hours during Monday – Friday, 09:00 – 17:00 CET.
